The main choice is whether to sell with the tenant in place or with vacant possession. Since the main tenancy reforms under the Renters’ Rights Act took effect in England on 1 May 2026, recovering possession requires closer planning. This guide explains both routes.

Can you sell a London property with tenants?

You can. Selling a buy-to-let property with tenants is common and a tenancy doesn’t stand in the way.If the property is sold with the tenant in place, the existing tenancy generally continues under the existing terms, with the buyer taking over the landlord’s responsibilities. This is called selling with tenants in situ.

The buyer is nearly always an investor, so they look at the rent, how reliably the tenant has paid and whether the paperwork is in order. Selling with vacant possession means that the tenant has left before completion.

Owner-occupiers can then bid as well as investors, so the pool of buyers is wider. The difficulty is getting the property empty. Since 1 May, that has become slower and more tightly controlled.

The right route depends on the property, the tenant and how soon you need to sell.

What Singapore landlords need to consider

Selling a tenanted property from overseas is more manageable than it sounds, provided you have someone on the ground to keep things moving.

London is seven to eight hours behind Singapore, so its working day extends into your evening. Our Singapore team can speak to you in your time zone and coordinate with our London colleagues and the tenant to keep the sale progressing.

Viewings

Buyers will want to see the property. If the tenant is living there, check the tenancy agreement and agree viewing times in advance. Giving notice alone does not provide an automatic right to enter for sales viewings.

Documents

A buyer’s solicitor will ask for the tenancy agreement, deposit protection details, safety certificates and the EPC. Pull these together before you list, not after the first offer.

Signing and identity checks

Expect identity checks and documents to sign. Your solicitor will explain how to sign and, where necessary, have documents witnessed in Singapore. Arrange this early to avoid delays.

The tenant

Tell them about your plan to sell early and plainly. Keeping tenants informed from the outset can encourage cooperation and help minimise disruption during viewings and the sales process.

What has changed under the Renters’ Rights Act?

Several changes under the Renters’ Rights Act affect landlords planning to sell a tenanted property in England.

If you last sold a rental property a few years ago, the rules have changed. Before 1 May 2026, eligible landlords in England could use Section 21 to seek possession without giving a statutory reason. New Section 21 notices can no longer be served, so landlords who need vacant possession must use an applicable legal ground.

For eligible tenancies, Ground 1A allows landlords who genuinely intend to sell to seek possession with at least four months’ notice. Keep dated records of your plans, such as agent instructions and sales valuations, to help demonstrate that intention. Some older assured tenancies are excluded, so check your tenancy type before serving notice.

Two limits apply. Notice can be served during the tenancy’s first 12 months, but it cannot expire before that period ends. Restrictions on re-letting generally run from the date notice is served until 12 months after the earliest date for possession proceedings specified in the notice, subject to statutory exceptions. If the sale falls through, you may therefore be unable to put the property straight back on the rental market.

If the tenant remains after the notice expires, you will need to follow the court possession process, with enforcement if necessary. Allow for this when planning your sale, as four months’ notice does not guarantee vacant possession within four months.

Private assured tenancies in England are now periodic, so tenants can generally end their tenancy with two months’ notice. A tenant may therefore give notice while the property is being marketed or the sale is progressing, which could affect the buyer’s plans.

If you are thinking of selling within the next year, consider the timing before letting a new tenant. A new tenancy brings a fresh 12-month protected period, which could affect your plans for vacant possession. Talk to us before deciding which route to take.

UK tax considerations for Singapore-based sellers

Selling UK property from overseas can bring UK tax and reporting duties. If you own the property personally and are non-UK resident for tax purposes, you must report the sale to HMRC within 60 days of completion, even if no tax is due, and pay any Capital Gains Tax owed within the same period. Whether you owe anything depends on your gain and your own circumstances.

Different rules apply to company-owned properties. Non-resident companies generally report gains from UK property sales through their Corporation Tax returns.

HMRC explains how to report and pay Capital Gains Tax on UK property on GOV.UK. Confirm your own position with a UK tax adviser before you accept an offer. And keep your purchase records, costs and improvement receipts together. You will need them to work out the gain.

FAQs

Can I sell my London property while it is tenanted?

Yes. You can sell with the tenant in place, usually to an investor or recover the property first and sell with vacant possession. Your route affects your timing and who can buy.

Will I pay UK tax when selling my London property from Singapore?

You may. If you own the property personally and are non-UK resident for tax purposes, you must report the sale to HMRC within 60 days of completion, even if no tax is due, and pay any Capital Gains Tax owed within the same period. A UK tax adviser can confirm your position.

Can I sell a UK rental property from Singapore?

Yes. Your solicitor can act for you remotely and your agent handles viewings and offers. Expect identity checks and documents to sign. Our Singapore team can be your point of contact from start to finish.

What happens to the tenant when a property is sold?

If you sell with the tenant in place, their tenancy continues and the buyer becomes their landlord. If you need vacant possession, you may be able to seek possession under Ground 1A, subject to the conditions above. If the tenant remains after notice expires, you will need to follow the court possession process.

Request a London property sales valuation

Selling a tenanted property comes down to timing, the right buyer and complete documentation.
